Amicus Curiae Briefs

The Association occasionally files Briefs Amicus Curiae in cases pending before Illinois courts of review when issues concerning the appellate practice of law arise. Recently, the Association filed such a brief in Caveny v. Bower, Ill. Sup. Ct. Docket No. 92963, to promote a rule-change proposal concerning the waiver of issues mentioned not briefed in the petition for leave to appeal. The brief supports an amendment to Supreme Court Rule 315, one of many proposals made jointly by the Association and the Illinois State Bar Association, which would allow appellants to limit their petitions for leave to appeal to issues warranting Supreme Court review and without waiving argument in their brief of any other properly preserved issue if the PLA is granted.

Here is a list of amicus curiae briefs the ALA has filed in recent years in the Illinois Supreme Court, Seventh Circuit Court of Appeals, and the Illinois Appellate Court.
